In today’s time, it has become really tough to live this life of self-isolation and still think of the future which is going to be tougher because maybe not soon but one day we all have to go out of our houses and have to work to earn money and live a life where we are at least earning a bread to eat and water to drink. But our Constitution here also succeeds all of us and has accepted technology in the best pay possible so that the cases don't file up and are heard at times.
What are Virtual Courts?
A Virtual Court is one of a new kind that could be the biggest contribution under e-Courts projects that will help enhance the working of the courts that are fully burdened with lakhs of cases pending. The first time in the year 2018 it was discussed by then Justice Chandrachud when he attended an inaugural ceremony for traffic offences and it became a big success. It will not only ease the overburden on conventional courts but will be a great chance for an era.
A detailed discussion of Justice DY Chandrachud regarding Virtual Courts for the first time:
Justice Chandrachud recently inaugurated Delhi virtual court system and in his speech addressing the people he said the judiciary shall embrace the use of e-governance. This was an event organised by the Information Technology of the Delhi High Court for making a virtual court system for traffic challans captured through CCTV Cameras.
It was also mentioned by Justice Chandrachud that the adoption of technology by the courts have also come into the picture by this pandemic and now we have to focus on how to proceed with it. He also mentioned that because of the picturization of virtual courts within a period of 10 minutes thousands of rupees have been already received and deposited. And this shows the unmatchable and vulnerable nature of virtual courts. Because of this new development not only courts will be benefited, but especially police can now totally focus on their regulatory duties, also Justice Chandrachud said that by this new development done by Delhi Courts other states such as Tamil Nadu, Haryana and Kerala are also thinking and promoting virtual systems. Justice added in his statement that to make it a success we can use the best version of the technology and can adapt provisions of our constitution pertaining to it such as Section 138 of The Negotiable Instrument Act.
Because of virtual courts, a lot has happened for the betterment of society. There are some points of advantages that one needs to acknowledge:
a) When we talk about virtual courts there are no face masks needed, as it has become a quintessential thing to wear before moving out for any workout from our respective homes.
b) There was a time i.e., post corona where all the lawyers were asked to rush before time to the courts. But now there is no rushing to courts and lawyers can calmly argue for their clients without burning their fuel.
c) Now it can be more eco-friendly because there will be no need for extra papers as lawyers can mail the necessary details to the judge or can show the important evidence through online mode.
d) All you need is now a good internet connection, computer, and willingness to adapt to the “new normal”.
Conclusion
As a matter of fact, the judicial system which we are followed from the very beginning needs some literal and serious concern so that it helps more to give justice to the needy and promotes less corruption and inefficiency of courts.
Seeing the immediate need for restructuring of our judiciary system, although coronavirus has negatively impacted all the other sectors all over the world, our judiciary should utilise this opportunity as a golden opportunity to envisage a justice delivery system that could function at all levels during this emergency. The virtual court is one such modern approach the judiciary can come up with and can help solve a number of pending cases that have piled up as old books in a historical library.

ReplyDeleteIn pandemic situation, the Courts ensured easy accessibility of justice in minimum cost by curtailing the expenses of parties. So, there is need to establish separate virtual Courts for settling disputes at minimum cost.
